Slander? by a Sal Pal?
This was on #starfleet this afternoon on the Fleetchat server. The crux of the issue is that Mary Kane, a known Sal Pal, openly accuses Chrissy Killian, the Regional Coordinator for Region 4, of Federal Mail Theft and theft and embezzlement of STARFLEET membership funds.
Chrissy used to head up the Membership Processing team. Mary Kane has insinuated that she has impeded the new Membership Processing team by removing the forward from her personal PO Box, opened STARFLEET membership packets after December 31, 2007 (when the new team took over) and made deposits of STARFLEET funds also after that date,
I simply cannot make this shit up.

Ok…Legally:
1) Anything addressed to Chrissy or STARFLEET, as she is a Regional Coordiantor, she can open
2) If she is faxing some or all of the infomration, the apperantly there is an agreement in place to let her do this, as someone must have given her a fax number. That would also authorize her to open them.
3) We all know it took a little while for the financials to transfer over. The only way it would be legally questionable would be if Chrissy is still depositing checks without authorization. Interestingly though, there is nothing I can remember in the STARFLEET Constitution that prohibits anyone in the organization from depositing STARFLEET Funds.
4) If Sal pushes to have her arrested, I will provide Chrissy with legal representation, and have the Federal Attorney prosecute anyone in STARFLEET Who filed the flase charges.

Martin, you are incorrect. If it is not addressed to Chrissy, she cannot legally open it. Since she is no longer MP, anything that says STARFLEET Membership Processing cannot legally be opened by her.
Chrissy admits to having made a deposit after January 1, 2008 of checks received prior to the changeover. Sal, et al, don’t really have an issue with that, as the sooner the checks got put in, the better. The issue is that she hasn’t turned over the documentation for that so that memberships can be matched up with payments. I understand from Sal that, as of yesterday, she has promised to do so.
She has also been instructed/requested to please NOT sit on packets until they accummulate, but to forward them as they come in. (It’s free, all she has to do is write FORWARD TO and the new address on the envelope.) That helps keep the checks from aging out, which sometimes leads to bouncing.
BTW, *I* never used the words “embezzle” or “theft” in regards to Chrissy. Others tried to put their words in my mouth.
And Ed? I didn’t start that rumor. That was Ann Garner, whose room was next to yours at IC99. BTW, according to the rumor, Kim wanted to sleep with you but you turned her down.
Long story short, if raising this ruckus helped Chrissy, Matt and Sal to get things worked out, I’m fine with it.

I would encourage you not to get into a legal pissing contest with me unless you have gone to and completed law school.
Chrissy *can* open mail, even if addressed to STARFLEET Membership Processing, as long as she has authorization to do so. In this case, the authorization is implied in the providing of a number to fax the contents to.
According to Commerce Bank and the Dept. of Treasury, all of which I have called today to make sure I get this right, checks can be cashed/deposited as long as the account the check is drawn upon is valid. That means that if I wrote a check from my bank account four years ago, and STARFLEET just gets around to cashing it today, it will still be cashable, as long as my account is still active.
Again, STARFLEET has *no* restrictions in the Constitution on who cashes checks.
As for the forward on the P.O. Box. Assuming that the Box in question is Chrissy’s private P.O. Box that she was lending to STARFLEET, then STARFLEET had no right in requesting that it be forwarded to them, irregardless of who the person requesting was as it would forward Chrissy’s private correspondance as well. Unlike anything Chrissy has done, the forwarding, if requested by STARFLEET would constitute both Tampering with the Mail and Mail Fraud, as the requester certainly wasn’t Chrissy.
So perhaps Mary, instead of shooting your mouth off when you obviously have no clue, as all your information comes from third party sources, you would do well to keep your mouth shut.

The transition, in many aspects was minimal and in many more, a joke. The old regime was slow in getting things to the new team, deliberately in my opinion.
Legally speaking, I haven’t a clue. Morally speaking, I am dismayed at the attitudes of those that post on the L list, etc. That is why I dropped off of it. Nothing of value.

Martin, as of January 1, 2008, Chrissy no longer had that authorization, as you well know.
Whether or not the bank will take the checks, the issue is that she had not, at the time, provided documentation of what was deposited to the new administration. Also, the older a check is, the more likely it is to bounce. That’s just a fact of life. (And some accounts DO have a 30 or 60 limit placed on them.) Sitting on up to 30 MP envelopes increases the chance that we might lose money.
ATTENTION: It is my understanding that Chrissy has agreed to, in future, forward these items as they come in, should they continue to arrive her mail.
I got my postal facts off the USPS.com site. Perhaps you might wish to include that in your legal reading, Martin.

Again, if thy gave her a fax number then the authorization to open the letter is implied. Add to that anything *postmarked* before Jan 1, Chrissy would legally be able to open anyway as per the “Mailbox Rule.” But you being a moron, unable to listen to lawyers and just an all out idiot, wouldn’t understand it.
Think for one minute you simpleton. If *SFI* put a forward on Chrissy’s *private* PO Box, the themselves are in gross violation of 18 USC 1700, 1701, 1702 & 1703 as it would delay Chrissy getting her private mail still going to that box. Additionally as SFI is not Chrissy, unless Chrissy put the forward on, they are guilty of Fraud under Federal Statutes. So if *ANYONE* should be sued it should be SFI. Of course you, being a legal layperson, wouldn’t realize that.

Now I’m not a lawyer or anything but even I know that just because Chrissy deposits a check in the SFI account doesn’t mean she did anything illegal. Now, if she tried to get money out of the account without authorization that’s where the real trouble begins.
