An Open Reply to FADM Sal Lizard
Thank you, Sal, for confirming the rumor. I will now assume it is a fact. Your new witch hunt is now Dave Lowe, flavor of the month.
I will not be removing the website. I am within my rights under the “Fair Use” laws of copyright of these United States of America. My rights to free speech are protected at the highest level.
Let’s review your accusations.
- Improper use of the STARFLEET Logo
No. The logo you see at the top is the STARFLEET FAIL logo. It is similar. But you cannot READ the word STARFLEET, you can only assume it says STARFLEET. The logo I chose to mangle was created by Danny Hall, based on the logo created by Kurt Rotihinger, which was never trademarked by STARFLEET, TISTFA.
Not to mention I have changed it enough to make it my own.
- Improper use of the name “STARFLEET”
No. I am granted the right under “Fair Use” (US Copyright Law, Title 17, Chapter 1, Section 107) to use trademarked or copyright protected materials for the purpose of education, criticism, and even parody or lampoon.
- The word “starfleetfail.com” in the URL
Gray area. It’s like walmartsucks.org and other similar ventures. I guess maybe I should disclaim that the site “is not associated with STARFLEET, TISTFA” or some such?
- I make money from starfleetfail.com
No. I do “sell” t-shirts. This is through Zazzle. However, to date I have sold one. To myself. Zazzle does insist on setting a minimum of 10% profit margin on all items. Any proceeds are earmarked to be donated to the STARFLEET Scholarship Fund. I do owe you $1.60 $1.95. I’ll cut you a check right away, it sort of slipped my mind.
- STARFLEET is losing members because of starfleetfail.com and/or the site impedes recruiting
Unlikely. This site gets at most 250 unique hits a week. Usually the same folks, too. No where on the site has anyone said “don’t join” or “don’t renew” or “demand a refund” or “repent! the end is nigh.” The people that come here LOVE STARFLEET and want to see it thrive.
Sal Lizard: YOU ARE KILLING STARFLEET spending all this money on lawyers to quell dissent. Sending propaganda at the member’ expense. The treasury is dwindling, and you wan to sue me.

I totally disagree that Lizard is killing STARFLEET. But I have a sneaky suspcion that maybe Sal Lizard isn’t really his name, and that he used to know Peter Gethers. But even sneaky suspicions can be mistaken, some times.
